KiraNow Terms of Service

1. Acceptance of Terms

Welcome to KiraNow ("App," "Service," "we," "our," or "us"). By downloading, accessing, or using KiraNow, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not download, access, or use KiraNow. These Terms constitute a legally binding agreement between you and KiraNow Services.

2. Eligibility

You must be:

• At least 18 years old
• Capable of forming a binding contract
• Not prohibited from using the Service under applicable laws

By using KiraNow, you represent and warrant that you meet all eligibility requirements.

3. Service Description

KiraNow is a bill-splitting application that allows users to:

• Create groups and add members
• Track shared expenses
• Calculate balances between users
• Facilitate manual settlements between users

Important: KiraNow is a tracking and calculation tool only. We do not:

• Process payments or transfers
• Hold user funds
• Guarantee that other users will honor their debts
• Provide financial or legal advice

4. Account Registration and Security

4.1 Account Creation

You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Security

You are solely responsible for:

• All activities under your account
• Keeping your password secure
• Immediately notifying us of any unauthorized access

4.3 Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Required by law

5. User Conduct and Responsibilities

5.1 Acceptable Use

You agree to use KiraNow only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You shall not:

• Misrepresent Information: Submit false expense information
• Harass Others: Use the Service to harass, threaten, or intimidate others
• Impersonate: Pretend to be another person or entity
• Exploit Bugs: Exploit errors or bugs for unfair advantage
• Reverse Engineer: Attempt to reverse engineer, decompile, or disassemble the App
• Overload Systems: Engage in activities that overload our infrastructure

5.3 Financial Responsibility

You acknowledge that:

• All expenses recorded must be legitimate and accurate
• You are financially responsible for expenses you record
• KiraNow does not verify the accuracy of expenses
• Disputes between users are their responsibility to resolve

6. Intellectual Property Rights

6.1 Our Rights

All intellectual property in KiraNow, including but not limited to:

• Software code
• Design elements
• Trademarks ("KiraNow")
• Documentation

are owned by or licensed to KiraNow Services. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6.2 Your Content

You retain ownership of data you input into KiraNow. By using the Service, you grant us a worldwide, royalty-free license to:

• Store, process, and display your data
• Use aggregated, anonymized data for analytical purposes

6.3 Feedback

Any feedback, suggestions, or ideas you provide become our property without compensation.

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using KiraNow, you consent to our Privacy Policy.

8. Financial Disclaimers

8.1 No Financial Services

KiraNow is NOT a financial institution, payment processor, or money services business. We do not:

• Transfer money between users
• Hold funds in escrow
• Provide payment guarantees
• Offer financial advice

8.2 User Disputes

All financial disputes between users are their sole responsibility. KiraNow:

• Is not a party to any financial agreement between users
• Does not mediate disputes
• Is not liable for unpaid debts between users

8.3 Settlement Feature

The settlement functionality:

• Only displays information for manual settlement
• Does not process transactions
• Relies on users' external payment methods
• Is provided "as is" without guarantees

8.4 User Verification Responsibility

When using settlement information from KiraNow:

• Always confirm account details directly with the recipient
• Send a small test amount first when possible
• Keep records of all transactions
• Report suspicious activity immediately

9. Fees and Payments

9.1 Current Pricing

Currently, KiraNow is free to use. We reserve the right to:

• Introduce premium features with fees in the future
• Change pricing with 30 days' notice
• Offer different pricing plans

9.2 Future Changes

If we introduce paid features, we will:

• Clearly disclose all fees
• Obtain your consent before charging
• Provide refund policies as required by law

10. Third-Party Services

KiraNow may integrate with or link to third-party services. We:

• Are not responsible for third-party services
• Do not endorse third-party services
• Recommend reviewing third-party terms and policies

11. Termination

11.1 By You

You may stop using KiraNow at any time by deleting the App.

11.2 By Us

We may terminate or suspend your access to KiraNow:

• For violation of these Terms
• For prolonged inactivity
• If required by law
• For any other reason at our discretion

11.3 Effect of Termination

Upon termination:

• Your right to use KiraNow ceases immediately
• We may delete your data according to our Privacy Policy
• Outstanding financial obligations between users remain

12. Disclaimers and Limitation of Liability

12.1 Disclaimer of Warranties

KiraNow is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OF CALCULATIONS

12.2 Limitation of Liability

To the maximum extent permitted by Malaysian law, KiraNow Services and its partners shall not be liable for:

• ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• LOST PROFITS OR DATA
• PERSONAL INJURY OR PROPERTY DAMAGE
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA

Our total liability shall not exceed the amount you have paid us in the past 12 months, or RM100, whichever is greater.

12.3 Exceptions

These limitations do not apply where prohibited by law, including for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded by law

13. Indemnification

You agree to indemnify, defend, and hold harmless KiraNow Services, its partners, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of KiraNow
• Your violation of these Terms
• Your violation of any rights of another person
• Any content you submit

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

14.2 Dispute Resolution

Any disputes shall be resolved as follows:

1. First: Informal negotiation (30 days)
2. Second: Mediation in Kuala Lumpur, Malaysia
3. Third: Binding arbitration under the Malaysian Arbitration Act 2005

14.3 Class Action Waiver

You waive any right to participate in class actions or representative proceedings.

14.4 International Users

For users outside Malaysia, you agree to submit to the jurisdiction of Malaysian courts for any disputes.

15. Changes to Terms

We may modify these Terms at any time. We will:

• Notify you of material changes via email or in-App notification
• Post the updated Terms on our website
• Update the "Last Updated" date

Your continued use after changes constitutes acceptance.

16. General Provisions

16.1 Entire Agreement

These Terms constitute the entire agreement between you and KiraNow regarding the Service.

16.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full force.

16.3 No Waiver

Our failure to enforce any right or provision shall not constitute a waiver.

16.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

16.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

Appendix A: Malaysian-Specific Provisions

A.1 Consumer Protection

A.3 Cooling-Off Period

If KiraNow introduces paid subscriptions, you may have rights under Malaysian distance selling regulations.
